General Terms & Conditions

This competition is organised by Lucre London Limited (“The Organiser”), on behalf of BIC UK and Ireland, Chaplin House, Widewater Place, Moorhall Road, Harefield UB9 6NS (“BIC”).

The Organiser reserves the right to amend these Terms and Conditions or cancel this competition at any stage, and accepts no liability to the Entrants as a consequence.

1. Eligibility
Entrants must produce an original design to be printed on the barrel of a BIC® 4 Colours pen. Entries must fit the dimension given: 65mm x 37.5mm or be scalable in the following ratio: 26:15.

Entry to this competition is open to persons who will be aged 13 years old or over on 18 July 2018 who are full time residents of the UK (including the Channel Islands and the Isle of Man) or the Republic of Ireland, except children or close relatives of any employees of organisations closely connected with the competition. Proof of age, identity and eligibility will be requested. An adult will be required to approve the entry and agree to these Terms and Conditions (including BIC’s use of the design submitted and its originality) on behalf of any entrant under 18 years of age. The adult may be the child’s parent, guardian or teacher.

For the shortlisted entries, if permission to enter was given by a teacher, the Organiser will contact the teacher and ask for confirmation of permission from the entrant’s parent or guardian. Any entry without parental permission will be disqualified.

If an entrant fails to comply with a request for proof of identity or proof of parental consent, or provides false or misleading information, the Organiser may at their discretion, disqualify the entrant from the competition, or, where appropriate allocate the prize to another eligible entrant. Such decision will be final and no correspondence will be entered into about a decision regarding eligibility.

2. Entry
Entry opens on Wednesday 18 July 2018 at 00.00 and closes on Wednesday 22 August 2018 at 11.59pm.

Submissions received outside of this timeframe will not be considered so please do not wait until the last minute to upload your entry.

The Organiser cannot guarantee continuous, uninterrupted or secure access to the competition website https://bicdesignandshine.com and is not responsible for any disruption to the competition or the website due to technical problems or otherwise due to events outside of its reasonable control.

The Organiser, its sub-contractors, agencies and/or any other organisation associated with this competition cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any server, Internet access, system or otherwise which may result in any entry being lost or not properly registered or recorded. Proof of sending is not proof of receipt.

3. How to enter
Entrants can only enter individually.

To be eligible to enter, individuals must create an original design that they would like to see featured on a BIC® 4 Colours pen (“Design”). Individuals can create their own Design and upload it, or they can create their Design using the tools made available on the website. All Designs must be original and comply with the provisions below:

  • The design must be a high-resolution JPEG (.jpg, .jpeg) or PNG (.png) file, not compressed.
  • Entries must fit within the dimensions: 65mm x 37.5mm or 26:15 ratio.
  • All entries must be the original work of the entrant and must not infringe the rights of any other party. Designs must not feature 3rd party brands, references or logos. The Organiser accepts no responsibility if entrants ignore these Terms and Conditions and entrants agree to indemnify the Organiser against any claim by any third party from any breach of these Terms and Conditions.
  • Entries must not contain defamatory, obscene, offensive or any other unsuitable material.

Any entries not following these instructions or meeting the above criteria will be immediately disqualified.

Entrants agree to assign to the Organiser on behalf of BIC all worldwide copyrights, reproduction rights and representation rights to the Design for the legal duration of the rights.

The Entrant agrees that BIC may freely reproduce the Design for the production and sale of BIC® 4 Colours pens, and/or other BIC stationery products. In addition, the Entrant accepts that the Design may also be used for promotional, advertising and any other communication purposes, on any media BIC deems to be appropriate at the time (notably but not exclusively through TV, digital videos, press releases, and point of sales).

By submitting a Design, the Entrant agrees that The Organiser on behalf of BIC or BIC may at its sole discretion edit or adapt the entry in any way necessary for the purposes listed in the clause above. And BIC may also change the colours or sizing of the design as required.

Entrants will be allowed to reproduce and/or publicly display the Design in order to show their portfolio of work and for purposes related to the competition.

No feedback will be provided to unsuccessful entrants.

4. Judging
Eligible entries will be judged by a panel of BIC representatives and an independent illustration and design expert. They will select the final shortlist of 10 entries which will be put forward for the public vote.

In the event the Organiser receives more entries than it is possible to judge within the timeframes set out above, entries will be selected on the basis of date order, with earliest being selected first.

The panel will judge entries according to 3 criteria as follows:

  1. Creativity – Why can’t the sky be red or the grass purple? Be original and think outside of the box.
  2. Composition – How well is the space used? What technical ability has been demonstrated? How well do the colours and patterns complement each other?
  3. Suitability – Does the design fit within the dimensions given and have mass appeal?

Shortlisted entrants will be notified that their entry will be put forward to the public vote by Thursday the 23rd of August. At this stage proof of age, identity and consent to the terms and conditions will be requested and a response must be received by 16:00, Friday the 24th of August.

5. Voting
The 10 shortlisted entries will be subject to a public vote via the Design and Shine microsite https://bicdesignandshine.com which will decide one overall winner.

Voting will go live to the public on 27 August 2018 at midday. Voting will close on 09 September 2018 at 11.59pm. Voters are only eligible to vote once. If multiple votes are received from the same source, only one will be counted.

The Organiser reserves the right to disqualify entries or suspend voting if it has reasonable grounds to suspect that any type of voting irregularities have occurred. The Organiser has the right to substitute an alternative selection method at its absolute discretion.

The winner of the public vote will receive confirmation that they have won on 10th September 2018.

In the event of a tie between two or more entries for the highest number of votes, BIC and The Organiser will judge the tied entries against each other and will select which tied entry will become the winner. Each tied-entry will be judged based on the judging criteria given.

By voting for an entry, voters will be automatically entered into a randomly selected prize draw to be in with a chance of winning one of three BIC® stationery bundles, up to a maximum value of £50. Winners of this prize draw will be contacted using the email address provided to verify their vote. If no response is received within 48 hours the organiser reserves the right to re-allocate the prize to another randomly selected winner.

6. Prizes
Subject to compliance with these terms and conditions, the winner will receive the following prize:

  • £3,000 cash

The winning pen design will be sold by BIC® in the UK and Ireland. BIC reserve the right to choose the date that the pen is released for sale, the volume produced and where it is sold. The winner agrees that in exchange for the prize money their Design can be reproduced on BIC® 4 Colours pens without any further remuneration. The winner agrees and acknowledges that the exact number of products produced featuring each Design will be determined by BIC in its absolute discretion and that BIC cannot control when the relevant products will be on sale in participating retailers, and the sale period is therefore unlimited and indefinite.

No other alternative prizes are available. Prizes cannot be transferred or sold by winners. Unless otherwise stated in the prize description, winners are solely responsible for any additional costs or expenses associated with claiming the prize.

The Organiser reserves the right to require that the parent or guardian of any person aged under 18 confirms in writing that they agree to be bound by the terms and conditions of the Competition and may accept any prize on behalf of a prize winner under the age of 18.

7. Entrants’ requirements
Shortlisted entrants will be required to take part in a photoshoot and may be required to undertake media interviews requested by the Organiser during the period 25 August 2018 to 31 December 2019 for marketing and promotional purposes. Entrants also accept that these may be used in further internal and external promotional material and presentations beyond this period by the Organiser and/or BIC.

The Organiser will request parental permission for shortlisted entrants under 18 years of age for any pictures which might be taken for publicity purposes including online use.

The 10 successful shortlisted entrants will be contacted by 24 August 2018; proof of age, identity and eligibility will be requested at this stage as well as any necessary parental permissions.

Shortlisted and winning Entrants undertake not to engage in any inappropriate behaviour during any stage of the competition or thereafter. Anyone in breach of this condition risks being disqualified from the competition.

The winner’s name will be displayed on the competition website during the period 10 September 2018 to 31 December 2019.

8. Other
The Organiser’s decision at all stages of this competition is final. No correspondence will be entered into.

The Organiser reserves the right to disqualify any entry which breaches any of these Terms and Conditions, or to withhold any element or all of the prize in its entirety if in its opinion entries do not reach the required standard.

The Organiser, its sub-contractors, agencies and/or any other organisation associated with this competition cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any server, Internet access, system or otherwise which may result in any entry being lost or not properly registered or recorded. Proof of sending is not proof of receipt.

These Terms and Conditions are governed by the laws of England and Wales.
